12DP： 謎のメール 管財人のサイト閉鎖？
とんこ様からメールをいただいて、読んでみましたが、正直言って真偽がわかりません。メールヘッダーがないと確認しようがないので、なんとも言えません。念のため、載せます。
Dear 12DP investors,
Due to ongoing security threats, I have shut down the Investor Web Portal. This has been done for security reasons only. The data in the Web Portal and in each of the investor accounts has been secured. Investors do not need to take any action in response to this email. Indeed, telephone calls and emails to my office with questions regarding why the Web Portal is not available will not be returned.
From this point forward, however, you must contact my office by telephone, email or fax with any and all changes to your name, email address or physical address. You will be required to provide your username and password to the Web Portal. My staff will then make the requested changes to your account.
Investors are reminded to keep their Web Portal username and password in a secure location at all times.

簡単にいうと、サイトの安全性（セキュリティー）の理由で管財人の（清算用）サイトを閉鎖せざる得ない状況になったそうです。ですが、管財人のサイトをみると何もかかれてないので、おかしいと思います。管財人はいつもまめに出したメールをサイトに載せるためからなんです。

そして、そのメールの中身は、現時点以降名前や住所変更をしたい人は管財人の事務所に直接連絡をするようにとかかれています。メールや電話やＦＡＸや留守電などを利用できるとのことです。また登録した人は、ＩＤとパスワードを絶対に忘れないように管理してください。

12DP： 管財人はStormPayの「利益」を請求に成功

With the assistance of U.S. Magistrate Judge Paul Abrams in the United States District Court for the Central District of California and after long and protracted negotiations, I reached a settlement with StormPay. You can find the Notice of Motion and Motion for an Order Approving the Settlement Agreement with StormPay, the settlement agreement and the supporting pleadings at the Receiver's website: www.tlennonfor12dailypro.com
Under the settlement, the receivership estate will receive $11,750,000 and StormPay's claims against 12DP in excess of $16 million will be waived by StormPay. I believe that approval of the Settlement Agreement is in the best interest of the estate and its creditors because it maximizes the return to the receivership estate with minimal expense and ensures a much quicker distribution to investors. Litigation involves certain risks and would necessarily involve considerable delay and significant expenses. If the claims were litigated, distributions to investors could be delayed by over a year and the costs to litigate could exceed $750,000.
The funds obtained from this settlement, plus the funds the estate currently holds in the approximate amount of $5 million, along with interest earned on these monies and other recoveries, will be utilized to pay the fees and expenses of the receivership and the remaining funds will become the basis for the recommended distribution to investors. The pro-rata distribution percentage will not be known until total claims and net cash available for distribution are determined. The Receiver and his professionals are currently working on both of these issues.

StormPayは12DPから取引費用などで約＄17.3Ｍの利益を得たため、管財人はそれを「違法利益」として管財人に渡すべきだと裁判官に申し込んだときに、StormPay側（NOVAとGlobalも含む）は話し合いを応じるようになりました。現在StormPayのお金は約＄12.4Ｍであって、破綻する可能性があるため、話し合いの結果で管財人に渡す金額は約＄11.7Ｍが決定されし、管財人に対するStormPayの請求（＄16.7Ｍ）も撤回されることになりました。

ＥＭＯ： 払い戻しの小切手が来た
先週末にアメリカから普通郵送でＥＭＯ管財人から手紙が来た。中身は小切手でした。ＥＭＯ口座の中にE-goldへ交換しようと思って入れたクレカにて＄２００だったけど、いろいろと忙しくて、そのまま放置してたらＥＭＯがTexas州の裁判に押さえられてお金を取り戻すことができなかったことになってしまった。すごい時間かかったけど、やっとお金が戻ってきたが。。その計算がひどいんだわ。
元金の23.5%でした。$200 X 23.5% = $47 。。。約４０００円。
これじゃ、手数料が７０００円としたら赤字だヽ(#`Д´)ﾉ。
結局換金も困難なだけです。記念としてとっておくことにしました。
ＥＭＯは１２ＤＰより早く計算が着いたけど、こんなありさまですね。
１２ＤＰは経費ががいろいろかかって、もともと＄５０Ｍあるらしいお金が、今＄１−２Ｍかしか残ってないという噂があって、払い戻しがあるとしたら、元金の何％になるでしょう？チャージバックで成功した人は一番よかったと思います。チャージバックが失敗した人はもうあまり期待をしないほうが身のためだと個人的に思ってしまいます。希望を持つのが良いことなんですが、結果にがっくりしないように、心の準備をしたほうが良いかもしれません。
最悪のパターンは、管財人が１２ＤＰのお金を使い果たして、マイナスになるため、プラスとされた人たちから請求をする可能性も否定できません。お金が全部StormPayに取られて、１２ＤＰの口座に戻したと言いつつ、管財人が知らん顔で請求することも考えられます。
管財人は決して、被害者の味方ではありません。
